Understanding the NHDM Divorce Mediation Process

Divorce mediation is a cooperative approach to restructuring your family without fighting in court. Rather than hiring opposing attorneys to fight one another, both spouses work together with a neutral mediator who facilitates discussion and helps each participant understand their options. The mediator does not represent either party or offer legal advice. Instead, the mediator provides valuable structure, information, and perspective so that both participants can make thoughtful, well-informed decisions. Mediation focuses on each person’s interests rather than fixed positions, creating space for productive conversation and mutual problem-solving. The goal is not to win or lose but to reach agreements that both participants can support going forward.

How NHDM Divorce Mediation Works in Montgomery County

The NHDM mediation process begins with both participants sharing relevant information with each other and the mediator, including financial details and any preliminary agreements already reached. During the first session, the mediator helps both spouses identify the topics that need to be addressed and confirms the scope of marital assets and liabilities. In the sessions that follow, participants work with the mediator to address property division, financial responsibilities, parenting arrangements, and communication planning. The mediator guides these conversations to help each person express their needs, consider different options, and work toward resolution at a pace that feels manageable. Each session builds on the progress made in the one before. Once all agreements are in place, the mediator prepares your Marital Settlement Agreement and Custody Stipulation for your review and approval. After you sign your Agreements, we will assist you in moving forward with the pro se filing process with the Court so you can obtain your Divorce Decree. All sessions are private and confidential, providing a safe setting for open discussion.

The Benefits of NHDM Divorce Mediation for Families in Montgomery County

Families throughout Montgomery County choose the NHDM mediation process because it allows them to stay in control of decisions that affect their lives. Mediation helps reduce the enormous emotional and financial strain that would come from litigation by replacing confrontation with cooperation. It encourages open communication between spouses, which is especially important when you have children. Because participants create their own agreements rather than having terms imposed by a court, the results tend to be more practical and lasting. The process is also private and flexible, with sessions scheduled around participants’ availability and paced according to their comfort. Above all, mediation is built around shared interests and informed decision making rather than winning and losing in court.

How does divorce mediation work?

Your attorney-mediator will guide you and your spouse in working together to reach an agreement. Mediators help couples separate their spousal role, which is ending, from their parental role, which is continuing. Couples learn to evaluate their present financial circumstances and provide for their future financial needs. With the attorney-mediator’s guidance, agreements aim to resolve both immediate and long-range concerns. The mediator will focus on your specific divorce issues and identify possible options. You will actively participate in the negotiations to resolve your divorce issues and create a mutually satisfactory agreement which addresses the needs of all family members. The attorney-mediator’s goal is to help a divorcing couple reach an agreement that meets everyone’s needs as efficiently and peacefully as possible.

Is mediation cheaper than retaining litigation attorneys to handle a divorce?

Significantly. We charge a set fee which is provided at the conclusion of your complimentary consultation. Our fee, which covers the entire mediation process, is generally less than the initial retainer set by most divorce litigators, and which you would have to replenish repeatedly in litigation. Typical litigated divorce costs run significantly higher than the cost of mediation. Also, keep in mind that “cost” not only means dollars spent but the emotional cost to the parties and their children who suffer through litigated divorces. This emotional cost is also greatly reduced by the mediation process.

Can mediation work if we do not agree on everything?

Yes, mediation often begins when spouses do not see eye to eye on important issues. The mediator helps participants identify shared interests, explore possible solutions, and communicate more effectively. Many participants find that even partial agreement in mediation helps reduce conflict and provides a clearer path forward.

Will our agreement be legally binding and enforceable?

Yes. Once your Marital Settlement Agreement is signed it is a legally binding contract. Mediated agreements are just as binding as the agreements reached during the litigation process and they have a better record of standing the test of time because both parties participated in creating it. When your divorce process is complete and your Divorce Decree is signed by a judge, the Marital Settlement Agreement will be incorporated into your Divorce Decree and the terms you have voluntarily agreed to will become a legally binding and enforceable Order of the Court.

Should I also retain a lawyer during mediation?

You are always welcome to retain outside counsel before, during and/or after the divorce mediation process has begun. Neither party may bring an attorney into the mediation sessions, but a well-informed participant is always a good thing. At one point in the divorce mediation process, your attorney-mediator will draft your Marital Settlement Agreement and invite you to have separate lawyers review it before you sign. During your divorce mediation process, your attorney-mediator may provide legal information but is not permitted to provide legal advice or representation.

Is mediation confidential?

Yes, mediation is a confidential process. Your communications with your mediator are confidential, which means your mediator will not share them with anyone outside of your mediation without your permission. Your negotiations during mediation are also inadmissible as evidence in court, which allows you to speak freely. Confidentiality encourages open communication and protects the privacy of both participants.
